Summary: The identity of transsexual and transvestite people presents themselves today as one of the most discriminated in Brazilian society. This phenomenon happens because of the normative ideals that establish that for a person to be considered human it needs to observe the norms that determine the coherence and continuity between gender, sex and sexuality. As trans subjects perform their genders in contravention of these norms, they become more vulnerable to physical, symbolic and lethal violence. It is in the face of this reality that we observe trans political subjects using the grammar of rights as a way of overcoming unequal conditions of life. Therefore, we question in this work: to what extent can the use of the grammar of rights by the movements of trans people positively impact on the democratic dynamics related to the citizenship of these subjects? For this analysis, we start from the theoretical-methodological assumptions of discourse theory. We conclude that, although the instrumentalization of this grammar conjures up its own dangers, since it depends to some extent on the bureaucratic activity of the State, it can still contribute to the transformation of the living conditions of the transsexual people.
