From the theoretical framework of the matter, as a preliminary issue, the paper will examine how that constitutional imperative was understood and developed in Costa Rica in the first decade of the 21st century by the jurisprudence of the Supreme Electoral Tribunal, the way in which that praetorian creation was later specified in the Electoral Code of 2009 and, later, it will review the lessons learned and the pending aspects of the adopted reform.
