Sumario: In the investigation reflects on the work of judges in a Rule of Law, taking as a starting point the principle of division of powers. The position assumed by Max Weber in the work “Economy and Society” is exposed, in relation to the creation and application of Law. It is established, in this article, that the topic as to whether the judges create or not Law keepscurrent, because the debate between rules and principles is not over. It is concluded, in relation to the interpretation of Law, that the foundation of the judgments in a political-institutional guarantee because it allows to control the jurisdictional activity and, consequently, the democratic legitimacy of the judges.
