Often, constitutional courts have connections with politics, they can act without impulse of parties and grant opinions and advise to political bodies. Additionally, the possibility of self-regulation, establishing the typology of judgments, or deciding on the temporal effects of the judgements, as well as the latitude of their discretion interpreting the Constitution and the law, gives them a freedom that is not so different from that of political bodies. It is then necessary to rethink the dichotomy.El artículo critica la dicotomía prevalente político/jurisdiccional utilizada para clasificar los sistemas de justicia constitucional; recuerda que en cada sistema de justicia constitucional conviven al lado de características jurisdiccionales formas «políticas » de control de la ley, y funciones otorgadas a los tribunales constitucionales que no son típicas de la jurisdicción; sobre todo, subraya que la propia noción de jurisdicción no es nítida. A menudo los tribunales constitucionales tienen conexiones estrictas con la política, pueden actuar sin impulso de parte y otorgar opiniones y asesorar a los órganos políticos. Sobre todo la posibilidad de autorregularse, de establecer la tipología de sentencias, de dominar los efectos temporales de las mismas, y la latitud de su discrecionalidad interpretando la Constitución, y la ley les confiere una libertad no tanto distinta a la de los órganos políticos.
