By virtue of this the present research article deals with the two main mechanisms, unification and harmonization, which have been developed to respond to these problems and in which the progress that they have provided is tangibility observed. In the international order, therefore, various doctrinal positions and legal frameworks will be presented, in order to understand the functionality, breadth and development that these schemes have provided to a new legal order known as International Trade Law. In which pursues as purpose states can match and collaborate to ensure the necessary legal certainty to the contractual parties of the new schemes of commercial businesses in order to achieve an expansion of the same.El fenómeno de la Globalización trajo consigo diversos cambios en el orden mundial, teniendo una especial repercusión en las formas de hacer derecho; mediante este fenómeno se pasó de un derecho comercial nacional a un derecho comercial de corte internacional, en este fueron buscadas soluciones para brindar una efectiva resolución a los conflictos que fuesen derivados de las nuevas formas de hacer comercio.
