In this article, the autor develops the legal treatment of this juridical figure and its applicable regimens, analyzing the juridical and economic implications of the two ways to protect its execution: juridical proceedings (ex ante) and extra juridical proceedings (ex post).Los colaterales son activos (materiales e inmateriales) que actúan como garantía ante cualquier operación financiera. Esta figura permite reducir los riesgos relacionados a las operaciones financieras por medio de la calificación crediticia del agente al que se respalda. Es por ello que una adecuada regulación de su ejecución permite reducir los problemas originados por la asimetría de información.
