The main objectives of the constitutional rule of law are peace and social welfare, in addition to providing the necessary mechanisms to guarantee all members of society the full use of their fundamental rights and the necessary legal security to avoid their violation. Penitentiary law must be seen today as the penalizing faculty of the State. This faculty is, among other things, the possibility of social sanitation and the implementation of public policies that help bridge the gap between the penalty and its execution. The State can no longer create harder laws to inhibit antisocial and unlawful behavior. It must devise the mechanisms that allow individuals who, in strict adherence to criminal law, have complied with their penalty to “reinsert themselves properly into society”, not only in the spirit of a guarantee, but as the only way to prevent new criminal behavior. |
