In this context, the paper reconsiders the role and characterization of empathy in the “Law and Literature” movement as a privilege site to calibrate the strenght, pretentions and the effects of the “empathy argument”; and also to reexamine its critical points.Durante la última década, la discusión sobre el valor de la empatía en el derecho y la filosofía ha cobrado una visibilidad creciente. Desde sus inicios a comienzos de la década de 1970, el movimiento “Derecho y Literatura” ha estado asociado a la introducción de la empatía en el derecho y, a la vez, la empatía ha sido uno de los focos de discusión más intensos dentro de las múltiples voces que integraron el movimiento.
