At the present time, in which recent events and social movements have renewed the struggle of women to find their place in society in terms of true equality, without discrimination, claiming their place in the labor area, in the political and representative, as well as a life free of violence among other issues, it is necessary to ask whether modern constitutionalist thought fits with these demands. This pretension that of course is not recent, but it has taken a new voice until recently silenced in many aspects to adapt it to the needs of today’s society. Many authors have tried in recent years to determine the origin, consequences and possible solutions of the original exclusion of women from the public sphere and most importantly, the development of the social contract, the germ of the subsequent inequality of women and men. This paper analyzes this issue giving both a historical and current vision of the situation of women from a constitutional point of view, to end up by uncovering, in a very succinct and non-restrictive way, which are some of the current shortcomings in this field and which can be the constitutional solutions to be applied to fill them |
