Summary: The study sets out the historical-juridical panorama that has based the action of the European Communities, now European Union, in the environmental field from its origins until the Treaty of Nice has ceased to be in force. In this sense, in a clear manifestation of the crystallization of European law in phases or in stages, the work shows how it has been passed from practically initial normative silence to the regulation established in Nice, pointing out the various contributions to this issue that have made the successive treaties that since the fifties of the last century have been conforming the so-called “primary law” , particularly focusing on the conventional instrument and its subsequent developments that in the start of the community building it served to create the then European Economic Community.
