Summary: The New Process Codification included, as an innovative figure, the Process baptized as Small claims procedures, which implies in favor of the creditor, the possibility of claiming its credit, whenever it does not have any title where it appears or can be recorded the debt that is have to with him. Although it is true, the figure aims to give new airs to the procedural legislation, our country was in arrears of its inclusion and recognition in the Positive Law. European and American foreign legislations show the positive reaches and results at the judicial level, the implementation of figures who, under different names, dedicate rights in favor of creditors without titles on which to base their credit. Time will indicate without doubt, the benefits or errors of its typification in the General Code of the Process.
