Considering this, the aim of this paper is to present, in a descriptive way, the basis and nature of the effective investigation, in order to clarify the origin of the duty for the state authorities, as well as the characteristics that the investigation must have to guarantee an adequate compliance with the European Convention on Human Rights.El derecho a una investigación efectiva ha sido consagrado por el Tribunal Europeo de Derechos Humanos, no como una mera declaración de intenciones, sino como una verdadera garantía que comporta la imposición a los Estados de un deber de actuación ante las agresiones más graves a los derechos humanos, con el fin último de alcanzar una verdadera y eficaz tutela de los mismos.
