This approach is presented as a discursive alternative to neutralize the claims of returning to the naturalization or biologization of these institutions and other social behaviors, by various legal subjects, both doctrinal and jurisprudential, as well as other social subjects, especially of confessional orientation.O artigo levanta a tese sobre o caráter institucional que revestem categorias como “sexualidade”, “familia” e “casamento”, bem como as relações que se suscitam entre elas nas sociedades e ordenamentos jurídicos contemporâneos que adotam a forma organizativa de Estados constitucionais de Direito. Este levantamento apresenta-se como uma alternativa discursiva para neutralizar as pretensões de retorno à naturalização ou biologização destas instituições e de outras condutas sociais, pelos diversos sujeitos jurídicos, tanto doutrinários como jurisprudenciais, bem como de outros sujeitos sociais, especialmente de orientação confessional.El artículo plantea el carácter institucional que revisten categorías como ‘sexualidad’, ‘familia’ y ‘matrimonio’, así como las relaciones que se suscitan entre ellas en las sociedades y ordenamientos jurídicos contemporáneos que adoptan la forma organizativa de Estados Constitucionales de Derecho.
