Although the connotation of the term hand in matters of children and adolescents is not the same as in a civil case, the various pronouncements of courts in several judgments of constitutional protection and have noted the requirement to comply with Article 29 of the Constitution relating to due process and even more so in such delicate matters as defining situations of children and adolescents.La Ley 1098 de 2006 es relativamente nueva y no ha sido fácil su implementación, entre otras razones por la disparidad de criterios de los responsables en su aplicación; esta Ley obliga a los miembros del equipo psicosocial a asumir responsabilidades y compromisos puesto que legalmente les otorga la categoría de peritos, es decir, unos verdaderos auxiliares de la justicia y sus pronunciamientos deben cumplir con todos los requisitos de un peritazgo, lo que conlleva que cualquier autoridad judicial o administrativa cite a los peritos a sustentar en audiencia los informes suministrados y que en consecuencia conlleva además a que tenga publicidad, es decir, que las partes los conozcan y puedan ser controvertidos.
