Summary: From the perspective of the liberal state, the interpretation of the law was unthinkable, example of this is reflected in the development of the exegesis school. But reality has set in this approach, and the transition to Constitutional state, the judge takes a key role in the creation of law and, before every decision, is facing a problem. So, interpretation within the law has taken on significant importance previously unthinkable. Thus there is the approach of the problematic thinking of the law. To this, we must face the problem of constitutional interpretation from a broader view about their chances, otherwise, Constitution will become an obsolete document and distant from social reality.
