In this article shows a synthesis from the final inform of the research titled: “The adversarial penalty justice and its influence on the justice problems in the municipality of Andes: the child case victim of sexual violence, research supported for Grupo Derecho y Sociedad and Fondo CODI-DR. For the development was outlined as categories: sexual violence and sexual abuse; protected legal well, typification and penalties in the penal law, the intervenient parts in the penal process; the approach of the sexual crime and the rights reestablishment of the children minor of 14 years victims of sexual violence. In this text are identified the principal problems in the implementation and articulation between different involved of the Colombian penal system of adversarial tendency, problem generator in Andes municipality. |
