First of all, by means of a historical recount about the business practices that are precedents to the modern companies; second of all, by means of historical monitoring to the norms of the Commercial Code, Decree 410 of 1971, that regulates the legal nature of the company how a contract. These two elements will allow to base these hypotheses: a. Contractual and plurality theory about companies in Colombia has its origin and support in the groups that, with intention to collect efforts and capitals, they were created in the trade practices previous to the codifications. b. Contractual and plurality theory about companies supports it in the european idea, that is contained in the codes of XIX century that arrive to Colombia with the reception of the positive company law.Este trabajo pretende mostrar como en Colombia ha regido la teoría contractualista y pluralista en materia de sociedades comerciales. En primer lugar mediante un recuento histórico sobre las prácticas mercantiles que son antecedentes de las sociedades modernas; en segundo lugar, mediante el seguimiento histórico a las normas del Código de Comercio, Decreto 410 de 1971, que consagran la naturaleza jurídica de la sociedad como un contrato. Estos dos elementos permitirán fundamentar las hipótesis según las cuales: a. La teoría contractualista y pluralista de las sociedades en Colombia tiene origen y sustento en las agrupaciones que, con el animo de reunir esfuerzos y capitales, se conformaron en las prácticas mercantiles anteriores a las codificaciones. b.
