For this purpose, we sought to work with a deductive approach, proposing a bibliographical review of what has been exposed on the thematic nuclei of the presented work, adopting a harmonized approach with the perspective of the constitutionalization of private law in the contemporary world.Este trabalho tem como escopo analisar o papel das novas plataformas colaborativas no contexto de profundas mudanças no modelo socioeconômico compreendido por um sistema de produção que redesenha a clássica estrutura mercadológica, envolvendo o contexto da propriedade intelectual, altamente necessitada de uma perspectiva funcionalizada de sua estrutura.
