Our Constitution of 1988 consecrates and welcomes the freedom of artistic expression, but it is up to the hermeneutics to interpret it as to the nature of art, its area and its scope. In this reasoning, the article tries to analyze the legal figure of the work derived from fanfiction, product of the new media era, a new form of copyright in a Cultural State that will have to be always attentive to public interests and private interests in the legal world . |
