In fact, the discussion has gone on for some time in the courts as the question of what processes and technologies to be covered by the concept of "genetic modification" and, in turn, which results from these technologies can focus on the term "genetically modified organisms modified ", incidences of double protection, royalty payments, among other issues. the study will examine the intersection between patents and cultivars in plant variety and / or plants and seek a proposal to neutralize and / or resolve conflicts of overlap between unique and different national laws on the matter.A sobreposição entre os direitos de patentes e cultivares ampliou-se com as denominadas tecnologias modernas de melhoramento vegetal. Diante deste fato a lei referente aos direitos de propriedade intelectual não acompanhou as inovações no campo biotecnológico, haja vista a ausência de limites ou mesmo uma neutralização legal relativo aos efeitos indiretos de uma patente de processo do material genético de plantas quanto a patentes de produto (sementes per si e derivados) que venham a harmonizar e equilíbrar as legislações pertinentes a matéria. Aliás, a discussão se arrasta há algum tempo nos Tribunais quanto a indagação de quais os processos e tecnologias que devem ser abrangidos pelo conceito de "modificação genética" e, por sua vez, quais os resultados decorrentes dessas tecnologias podem incidir no termo "organismos genetícamente modificados”, incidencias de dupla proteção, pagamentos de royalties, entre outras questões.
