Based on the integrity and identity ideas, according to the theories of Ronald Dworkin and Charles Taylor respectively, rebuilds them new concepts, inventive activity and industrial application of Law No. 9279/96 at the time of application to the case of patenting follow on drugs. At the end of this article, the defense of the patentability of drugs is sustained, not only by conventional logic, but mainly for the reconstruction of the problem situation having as north the proposed theoretical framework.O presente artigo objetiva estudar o direito à patente das follow on drugs (drogas seguidoras). A discussão se concentra na possibilidade de se patentear drogas que acrescentam pouco ou aparentemente nenhum avanço terapêutico em relação a outras drogas já disponíveis no mercado de fármacos. A partir das ideias de integridade e identidade, conforme as teorias de Ronald Dworkin e Charles Taylor respectivamente, reconstrói-se os conceitos de novidade, atividade inventiva e aplicação industrial da Lei n° 9279/96 no momento de sua aplicação ao caso da patenteabilidade das follow on drugs.
