Summary: Market relations between companies holding the protected agricultural technology and farmers constitute a sore factor in that concern the contracts or licensing agreements and the setting of royalties. There are situations in which the practice differs from theory. Under the protection of the instruments of licensing agreements or contracts, biotech companies, holders of high market concentrated power, tie the contracting parties through clauses considered anticompetitive, unfair and illegal. This is what we will discuss in this paper.
