This work intends to invest in a timely manner, the TRIPS Agreement of the World Trade Organization, and on what would be their main repercussions in the Brazilian legislation, especially on technological innovation policy. Our objective is to find what is the kind of regulation that was produced from two views that permeated the multilateral arenas: on the one hand the central powers, who demanded strict standards of protection for intellectual creations against piracy and in favor of free markets and at the opposite, the middle powers in the search for flexible rules that exclude sectors considered as strategic for export and seeking technical cooperation, science and technology transfer. For the methodology will be used exploratory procedure, from the analysis of the TRIPS Agreement, the main Brazilian standards on intellectual property and the Productive Development Policy of Brazil, as well as analysis of relevant literature on Public International Law and International Relations. It concludes that the TRIPS-plus practices were one of the main outcomes of the agreement that damaged or delayed the possibility of achieving the multilateral trading system integration objectives. And in Brazil stand out the manifesto for reform of legislation relating to intellectual property and the creation of the Innovation Policy, which regulates the cooperation activities in education, research and market performed in partnership between State-University-Industry (Industry). The proposed issue is on the day's agenda as an attractive to new research on the dialogue between Public Policy, Law, Development and Technology.

The proposed issue is on the day's agenda as an attractive to new research on the dialogue between Public Policy, Law, Development and Technology.O presente trabalho pretende investigar, de maneira pontual, o Acordo TRIPS da Organização Mundial do Comércio, e sobre quais seriam as suas principais repercussões na legislação brasileira, em especial sobre a política de inovação tecnológica. Objetiva-se verificar qual é o tipo de regulamentação que foi produzida a partir de duas visões que permearam as arenas multilaterais: de um lado as potências centrais, que reivindicavam normas rígidas de proteção às criações intelectuais contra a pirataria e em favor do livre mercado e, ao oposto, as potências intermediárias na busca por normas flexíveis que excluíssem setores considerados como estratégicos para a exportação e buscando cooperação técnica, científica e de transferência de tecnologia. Para a metodologia será utilizado o procedimento exploratório, a partir da análise do Acordo TRIPS, das principais normas brasileiras sobre a propriedade intelectual e da Política de Desenvolvimento Produtivo do Brasil, além da análise da bibliografia especializada em Direito Internacional Público e Relações Internacionais. Conclui-se que as práticas de TRIPS-plus foram um dos principais desdobramentos do referido acordo que prejudicaram ou postergaram a possibilidade de cumprimento dos objetivos de integração do sistema multilateral de comércio. E no Brasil destacam-se o manifesto pela reforma da legislação referente à propriedade intelectual e a criação da Politica de Inovação, que regulamenta as atividades de cooperação em ensino, pesquisa e mercado desempenhados na parceria entre Estado-Universidade-Empresa (Indústria).
