Summary: The present work analyzes the light of domestic and international law issues about patenting human genetic material using as reference the jurisprudential Case Oliver Brüstle x Greenpeace. For this purpose make a comparative analysis between the intellectual property laws of some countries in Latin America, as well as the specifics of the Biotechnology Directive 44/98 and then the following relevant to the proposed topics: Case v. Oliver Brüstle. Greenpeace, facts and questions of Case, Article 27 of TRIPS, Directive 44/98, the peculiarities of Articles 10 and 18 of Law 9.279/96, the intrinsic requirements of patents in optics of Law 9.279/96 and Policy 44/98.
