Therefore, and for such purposes will first proceed to define the legal problem, showing various responses given by the national law, then provide a plausible solution to that question from the point of view of jurisprudence and constitutional.El presente artículo tiene por objeto dilucidar cuáles son las reglas probatorias que deben de ser aplicadas en el incidente de reparación integral, puesto que en la praxis judicial colombiana se presenta la dificultad de establecer si han de ser éstas las del Código General del Proceso o las del Código de Procedimiento Penal, no existiendo acuerdo aún en dicho aspecto.
