In the development of the new social realities, the fundamental social rights are essential support for the social estate law, after a while they became inherent to the institutional power of the liberal estate. An attribute of the individual person as a collective human being and the basis of its legitimization in order to recognize them as constitutional, however, they are ambiguous. In Colombia, after the 1991 constitution reform, the social estate law was established as an explicit clause and a fundamental principle guiding theLa transformación del Estado Liberal, de Estado Gendarme a garantizador de la dignidad humana, encuentra en el Estado Social de Derecho y en la constitucionalización del Derecho su fundamento, que se expresa en el derecho a la igualdad material, la dignidad humana y el pluralismo de la sociedad que surge como contrapeso frente a la concepción rígida, jerarquizada y de interpretación abstracta o formalista del derecho. En desarrollo de las nuevas realidades sociales, los derechos sociales fundamentales son un soporte primordial del Estado Social de Derecho, que de un tiempo para acá, pasan a ser inherentes al poder institucional del Estado Liberal, un atributo de la persona individual como ser colectivo y base de su legitimación, a través de reconocerles rango de norma constitucional, a pesar de esto, presentan ambigüedad.
