Currently, its uniformed members who are on active duty may be investigated and prosecuted by the Military Criminal Justice when they commit offenses in relation to police duties. Once the armed conflict ceases, the creation of a special justice is proposed that is part of the ordinary criminal justice, it could even be operated by retired members of the National Police. But nothing prevents that for these uniformed police officers the judges are the same as those for other Colombians, provided all the social, legal, factual and other psychosocial aspects that can be involved are taken into account when these special public servants are being investigated, accused or judged.El objetivo principal de este escrito tiene como fin cuestionar la pertenencia de la Policía Nacional de Colombia a la justicia castrense en el posconflicto con una adecuación o correspondencia de algunos soportes y fundamentos de las categorías analíticas y elementos teóricos de la sociología jurídica. Actualmente sus miembros uniformados que se hallan en servicio activo, pueden ser investigados y juzgados por la justicia penal militar cuando cometen delitos en relación con la función policial. Una vez cese el conflicto armado, se propone la creación de una justicia especial que haga parte de la justicia penal ordinaria; inclusive, podría ser operada por miembros en retiro de la Policía Nacional.
