First, one must examine the theory on aspects such as: the division of powers that if analyze in a critical way stablishes four assumptions: homogeneous hierarchy, coordination among powers, the State checks and balances, and finally, the legality developed by the mentioned authors and taking into account what has been theorized by Carl Schmitt and Giorgio Agamben. Secondly, the Constitutional postulates will be critically analyzed under the themes mentioned above and using as a measure the contrast between positive law and legal dogma.Dos autores sobresalen como referentes teóricos en el derecho constitucional mexicano, aun sin un reconocimiento ejemplar en la historia. Son sin dudaparticipantes en el debate del Constituyente Mexicano de 1917: John Locke y, sobre todo, Charles Louis de Secondant. Sus influencias colaboraron de maneraactiva en la composición estructural de la parte orgánica constitucional. En primer término, se observará lo teorizado sobre: la división de poderes analizando la propuesta de manera crítica y de la cual se establecen cuatro supuestos: la jerarquía homogénea, la coordinación entre los poderes, los pesos y contrapesos estatales y, por último, la excepcionalidad jurídica que se encuentra no solo desarrollado con los autores mencionados, sino se tomará en cuenta lo teorizado por Carl Schmitt y Giorgio Agamben.
