The European Court of Human Rights has had an opportunity to rule on surrogate pregnancy, although we can say that it has not referred properly to surrogate motherhood contracts, but actually this case law is more related to the effects of a filiation derived from a surrogate motherhood practiced in a country that admits it by nationals of another country that prohibits it, and that seek recognition in their country of origin, and at this point the existence of biological links between the child and the intentional parents and the duration of the coexistence between them are decisive.Dentro del marco general de las técnicas de reproducción asistida, destaca la gestación subrogada, que recibe distinta consideración y tratamiento en los distintos países, desde la radical prohibición hasta su aceptación incluso en la modalidad comercial.
