The International Criminal Court recently confirmed its jurisdiction in the caseagainst Bosco Ntaganda, on alleged war crimes of rape and sexual slavery committedagainst child soldiers belonging to the same armed group of their aggressor. Thisarticle will critically examine the reasons and justifications provided by the Courtto establish its jurisdiction, and, in particular, the interpretation made by the Courtregarding the need to incorporate additional requirements to the description ofwar crimes of rape and sexual slavery within the established framework of international law.For these purposes, we will begin by analyzing the traditional concept of protectedperson in humanitarian law, highlighting then the essential aspects of the Court’sdecision. Next, we will examine the fundamental differences between letters (a)and (c), on one hand, and letters (b) and (e), on the other, both of Article 8.2 of theRome Statute, in order to determine whether the international humanitarian lawconfirms the conclusion of the Court in relation to crimes committed withinarmed groups. Finally, some conclusions and alternatives are presented, whichcould allow the Court to exercise jurisdiction over this type of crimes, even if thevictims were adult members of the same armed group.

No presente artigo se examinarão criticamente os motivos e justificações outorgadas pela Corte para estabelecer sua jurisdição, e em particular, a interpretação realizada pela Corte respeito à necessidade de incorporar requisitos adicionais à descrição típica dos crimes de guerra de estupro e escravidão sexual sob o marco estabelecido do direito internacional.Para estes efeitos, se começará analisando o conceito tradicional de pessoa protegidano direito humanitário, para depois destacar os aspetos essenciais da decisãoda Corte. A continuação, se examinarão as diferenças fundamentais queexistem entre os apartados (a) e (c), por uma parte, e (b) e (e), por outra, ambosos dois do artigo 8.2 do Estatuto de Roma, de maneira de determinar e o direitointernacional humanitário amparava a conclusão da Corte em relação com oscrimes cometidos ao interior de grupos armados. Finalmente, expõem-se algumasconclusões e alternativas que poderiam permitir à Corte exercer jurisdiçãosobre este tipo de crimes, inclusive se as vítimas fossem membros adultos domesmo grupo armado.Recientemente, la Corte Penal Internacional confirmó su jurisdicción en el casoseguido contra Bosco Ntaganda, sobre presuntos crímenes de guerra de violacióny esclavitud sexual cometidos contra niños soldados que pertenecían al mismogrupo armado que su agresor. En el presente artículo se examinarán críticamentelas razones y justificaciones otorgadas por la Corte para establecer su jurisdicción y en particular, la interpretación realizada por la Corte respecto a la necesidad de incorporar requisitos adicionales a la descripción típica de los crímenes de guerra de violación y esclavitud sexual bajo el marco establecido del Derecho Internacional. Para estos efectos, se comenzará analizando el concepto tradicional de persona protegida en el Derecho Humanitario, para luego destacar los aspectos esenciales de la decisión de la Corte.
