The reform of the Regulation of Public Subsidies of
Castilla-La Mancha by Decree 49/2018 allows the
author of these lines to reflect, first of all, on the
difficulties of understanding a concept such as the
"foundation of the public sector", in whose definition
their competences are affirmed by three different legal
systems that are not always compatible: those of the
European Union, the Spanish State and the
Autonomous Governments.
Secondly, the controversial adaptation that in Decree
49/2018 has been made of the 16th Additional
Provision of Law 38/2003, of November 17, General of
Public Subsidies, is commented. And, finally, two
examples are cited of precepts that, despite having
been modified by Decree 49/2018, continue to present,
in the author's opinion, contradictions with the basic
state legislation |
