Summary: The sentence of the Spanish Constitutional Court 39/2016 contains a new pronouncement on the video surveillance at the work place. Starting from this resolution the personal data protection fundamental right is analyzed. In workplace, The Court leaves definitively the doctrine of the privacy protection. Nevertheless, new questions arise in relation with personal data protection right in workplace surveillance. This sentence supposes a change in the doctrine that up to the moment had supported the Constitutional Court in the STC 29/2013.
