The mobility regime within the EU has certain peculiarities for EU citizens but also for third-country nationals. A minimum European family model can be identified. In addition, there is a trend towards the recognition of already established families, in particular, when they have established themselves as families in another EU State. In the field of immigration law, the way to accredit and make effective the family relationships does not coincide in all cases with the classical methods of private international law. Sometimes there are two different approaches, civil and administrative, on the same family relationship. Immigration law should be subject to the right to family life, in particular to the protection of the best interests of the children and their right of relationship with both parents as guiding principles of all decisions that affect them.La movilidad transfronteriza de personas requiere una adecuada protección de su derecho a la vida familiar, lo que implica, en consecuencia, la posibilidad de trasladarse y residir con los miembros de la familia en otro Estado. El régimen de movilidad dentro de la UE tiene ciertas particularidades para los ciudadanos de la UE pero también para nacionales de terceros países. Puede identificarse un modelo mínimo de familia europea. Asimismo, existe una tendencia al reconocimiento de familias constituidas, en particular, cuando se han establecido como familias en otro Estado UE. En el ámbito del Derecho migratorio, la forma de acreditar y dar eficacia a las relaciones familiares no coincide en todos los casos con los métodos clásicos del Derecho internacional privado. Existen en ocasiones dos visiones diferentes, la civil y la administrativa, sobre la misma realidad familiar.
