Summary: Peruvian liberalization in the early 1990s, supported by the fundamental influence of the principle of horizontal subsidiarity, produced not only utilitarian and normative changes in sectors (with the consequent diminish of the State as a provider), but also the creation of a new organizational administrative structure that serves and accommodates certain characteristics of apparent «new» regulatory powers, which – from a more strict and executive version – entail an adaptation of the administrative police and other competencies that allow the correct intervention and the support of these liberalized sectors. The present work attempts to unravel these myths and other juridical truths about the emergence of this organizational formula close to being 26 years of existence.
