Judgment of the Supreme Court 241/2013 of 9 October established the abusive character of the ground clauses, but as will be explained later, generated a great controversy regarding the effects of this declaration, discrepancies, settled by the Judgment of the Court of Justice European Union of 21 December 2016.En la presente obra se pondrá de manifiesto la realidad jurídica existente en España, en relación al carácter abusivo de determinadas cláusulas en los contratos hipotecarios. Dichas cláusulas perjudican al consumidor hipotecario, siendo el ejemplo más paradigmático el de las denominadas cláusulas suelo que, limitan el tipo de interés mínimo variable.
