Summary: The National Margin of Appreciation is a hermeneutic rule born in the European system providing the states a margin to interpret conventional regulations taking into account the direct contact between national authorities and civil society. This has particular application in cases involving economic, social and cultural rights. The scope of this theory transcended to being adopted by the Inter-American System and specially Argentina. Contextual differences allow a comparison showing the Inter-American System in a rearmost position relative to its European counterpart. Argentina recognized this theory but it has not reached a successful development.
