The paper concludes asking whether or not to reform the article studied, and concludes proposing some adjustments of the ordinary legislation that will improve its application in the future.El presente trabajo examina el largo proceso de formación de Gobierno que hemos tenido en España a lo largo de los últimos meses. El artículo explica los cambios en la situación política y evalúa el funcionamiento del art. 99 de la Constitución a la luz de estos. Una especial consideración se presta al papel del rey en el procedimiento de formación del Gobierno, en términos generales y prestando atención a la actuación del rey Felipe VI.
