During two terms — XI and XII —, since the dissolution and call elections on 26th October 2015 to the election by the Congress of Deputies of the President of the Government on 29th October 2016, there have been a large period without precedent in the Spanish Constitutional system, during which the Parliament has been ready to fulfill its role, except for appointing a new Prime Minister according to section 99 of the Spanish Constitution. On the other side the caretaker Government has legal limitations such as to introduce the budget, bills, or other activities, and should remain strictly limited to ensure the maintenance of the administration. In these circumstances the caretaker Government took the line that it would not be necessary to be submitted to the parliamentary control. As a result of that the Lower House has adopted the decision to submit this conflict before the Constitutional Court.Desde el 26 de octubre de 2015 al 29 de octubre de 2016 se ha producido una coyuntura constitucional ciertamente novedosa porque el Gobierno estuvo en funciones mientras que el Parlamento elegido para la XI Legislatura —desde el 13 de enero de 2016 hasta el 3 de mayo de 2016— y, tras la legislatura fallida, el Parlamento elegido para la XII el 26 de junio de 2016 —constituido el 19 de julio y hasta la investidura el 29 de octubre— fueron unos Parlamentos con absoluta capacidad parlamentaria; esto es, un Gobierno en funciones prácticamente a lo largo de un año y un Parlamento en plenitud alrededor de siete meses transcurridos a lo largo de dos distintas legislaturas. ¿Qué sucedió a lo largo de esta etapa sin precedentes en el régimen constitucional de la Constitución de 1978 y qué lecciones constitucionales se pueden extraer de lo sucedido? ¿Cómo han afectado al control parlamentario propio de un sistema parlamentario estos hechos?
