Summary: Summary: The growing development of the collaborative economy raises many issues from a legal perspective, which often require a reinterpretation of rules and concepts traditionally developed in another context and for other purposes. One of the problems most in need of new legal construction is precisely that of the regime that should be assigned to the "online platforms", which are the necessary support points for the aforementioned development. The aim of this work is, to establish first of all the nature of their activity, in order to deduce from it the content of the function and the services they provide, as well as the scope of the liability they must assume. The most widespread model so far leans towards its consideration as simple intermediaries, without prejudice to exceptions linked to a more active role, or to other circumstances. Throughout the work, and once the indicated aspects have been raised, the status of the matter is reviewed in provisions and other community and national documents that contain criteria of interest for the configuration of the online platform regime, especially as regards its function and liability.
