The purpose of this research was to determine the competent court to hear complaints against administrative acts imposing disciplinary sanctions of suspension or dismissal issued by other than the Attorney General’s Office authorities. The methodology was descriptive, theoretical reflection and critical analysis, a process of historical background check for a universal frame of reference was made. It was noted that before the Legislative Omission of the law 1437 of 2011, the Second Section of the State Council implied powers granted by analogy, extension and assimilation to the Administrative Courts in the first instance to hear these matters. It was concluded that the allocation of powers is constitutional and legal reserve and that the position of the State Council set up an organic defect due to lack of functional competence that violates the right to be heard by a judge.

A metodologia foi descritiva de reflexão teórica e análise crítica; realizou-se um processo de revisão histórica com antecedentes para um âmbito referencial universal. Observou-se que ante a omissão legislativa da lei 1437 de 2011, A Seção Segunda do Conselho de Estado outorgou competência implícita, por analogia, extensão e assimilação dos Tribunais Administrativos em primeira instância para conhecer estes assuntos. Concluiu-se que a assinação de competências é de reserva constitucional e legal e que a postura do Conselho de Estado configura um defeito orgânico por falta de competência funcional que violenta o direito para ser julgado por um juiz natural.El propósito de esta investigación fue determinar el juez competente para conocer de las demandas en contra de actos administrativos que imponen sanciones disciplinarias de suspensión o destitución, expedidos por autoridades distintas a la Procuraduría General de la Nación. La metodología fue descriptiva, de reflexión teórica y análisis crítico; se realizó un proceso de revisión histórica de antecedentes para un marco referencial universal. Se observó que ante la omisión legislativa de la Ley 1437 de 2011, la Sección Segunda del Consejo de Estado otorgó competencia implícita, por analogía, extensión y asimilación a los Tribunales Administrativos en primera instancia para conocer de estos asuntos.
