This norm seeks to provide personal assistants and legal support to those individuals with functional diversity and whose economic situation prevents them from having access to those services. In addition, it establishes the annulment of the “Interdiction” “Insanity”, and “Caretaker Appointment” established in the family and civil codes. Hence, Bill N° 9379 advocates the recuperation of the capacity to act of these individuals with which they regain those personal rights that they had lost with their disqualification. Among such prerogatives is the right to active suffrage; thus, those individuals that by virtue of compliance with a civil sentence had been segregated from the list of registered voters were registered againEn el marco del vigésimo aniversario de la promulgación de la Ley 7600, y habiéndose cumplido ocho años desde la ratificación de la Convención sobre los Derechos de las Personas con Discapacidad por parte del Estado costarricense, se promulgó en agosto de 2016 la ley 9379 para la Promoción de la Autonomía Personal de las Personas con Discapacidad. Esta norma busca dotar de asistentes personales y apoyo legal a aquellos sujetos con diversidad funcional cuya situación económica no les permite acceder a tales servicios. Además, estatuye la anulación de los regímenes de “Interdicción”, “Insania” y “Nombramiento de Curador” dispuestos en los códices civiles y de familia. Así, la Ley 9379 aboga por la recuperación de la capacidad de actuar de estos individuos, con lo que recobran aquellos derechos personales que habían perdido con su inhabilitación.
