Summary: The construction of a theory that recognizes the special faculties of collective traditional appropriation over traditional knowledge is born from the interpretations given to the need for conservation and protection of life forms, identity, autonomy and relationship with the territory and natural resources of ethnic communities. Although legal regulations do not expressly indicate an obligation of collective recognition and protection of traditional knowledge, nor do they express whether these powers can be translated into rights or only into benefits, it does not mean that such legal obligation of recognition and protection does not apply to national law. For all this, an analytical study is made in this article on the type of law generated from the creation, custody and collective historical use.
