Summary: The Judgment of the Court of Justice of 4 September 2001 interprets, in a homogeneous way, what must be understood as a fact of circulation and, therefore, the scope of compulsory motor vehicle liability insurance coverage in the EU. The interpretation made by the CJEU implies the de fact consideration of the movement, covered by compulsory insurance, the use of a vehicle according to its usual function. This interpretation conflicts with the content of articles 2.1 and 2.2 of the Regulation of Compulsory Insurance of civil liability in the circulation of Spanish motor vehicles. The conclusion of this work proposes the modification of the aforementioned legal precepts, in order to accommodate the interpretation of the CJEU that extends the scope of coverage of compulsory insurance of motor vehicles, which contemplates Spanish.
