The paper deals with the evolution of Italian regionalism from the reasons for
its introduction in the Constitution to the problems of implementation and reform. Starting
from the result of the constitutional referendum which rejected the constitutional reform,
the work studies the constitutional jurisprudence that best illustrates the main critical aspects of Italian regionalism. To describe the gradual narrowing of regional competences,
the paper analyses the decisions of the Constitutional Court on the economic crisis. The
paper focuses on the principle of cooperation used by the Constitutional Court to resolve the
competence overlaps between the State and the Regions. If there is no transformation of the
Parliament, this is a key principle for warranting regional autonomy. In this perspective, the
article analyses the most recent Constitutional Court judgements which invoke the principle
of loyal cooperation. Finally, the role of the Parliamentary Committee on Regional Issues
will be emphasized. This Commission, pursuant to Article 11 of the Constitutional Law of
18 October 2001, no. 3, is called upon to intervene in the process of adopting the laws of
regional competence.

Partendo dal risultato del referendum costituzionale del 4 dicembre che ha respinto la legge costituzionale del 2016, il lavoro indaga i principali punti critici del regionalismo italiano, attraverso la lente della giurisprudenza costituzionale. Viene dedicata particolare attenzione alle sentenze della Corte costituzionale vincolate alla crisi economica per descrivere il processo di riduzione degli ambiti di intervento regionale. Il lavoro si sofferma anche sul ruolo svolto dal principio di leale collaborazione, richiamato con costanza dalla giurisprudenza costituzionale al fine di risolvere gli intrecci di competenza tra lo Stato e le Regioni. Tale principio, in assenza di una trasformazione del Parlamento, mantiene inalterata la sua funzione di garanzia delle autonomie territoriali. In questa prospettiva si analizzano le più recenti pronunce della Corte costituzionale che hanno richiamato il principio di leale collaborazione. Infine si sottolinea il ruolo che potrà svolgere la Commissione parlamentare per le questioni regionali.
