El derecho de contratos requiere ser justificado políticamente, y la teoría del derecho de contratos cumple un rol fundamental en dicha justificación. El artículo analiza la necesidad de una teoría del derecho contractual, explora su metodología y formula la distinción entre el rol de la dogmática y el de la teoría.
