El tema es abordado desde la perspectiva de la legitimidad política y constitucional. En el transcurso de la investigación se presentan algunas nociones schmittianas, como las de Estado moderno, poder constituyente e identidad y representación, que guardan directa vinculación con la cuestión analizada.
