The impact of new technology has made us to reconsider the classic configuration of law that we have had until now. With the arrival of the new technologies, our lives have changed
together with the way to understand our Society and its Law. New technologies are here, living among us and have come to stay, but are we ready for it? New risks and new types of criminal offences have emerged. Sometimes the legislator had to first create these types of criminal offences while in other cases our Law was prepared for these attacks. Increasingly more and more frequently, minors have access to electronic and telematic devices at earlier ages, and thus access to social networks and the door open to all kinds of risks. But, do we really know what the legal regulations in this area and the minimum age for minors to access social networks? The issue raises numerous questions: What age are minors allowed to access to these kinds of social networks? Is there any age limit? ¿ Does exist any control of verification and authentication for this type of requirement?¿What is the privacy policy of social networks such as Facebook, Twiter or Instalgram ( to mention just some of them ), in relation to minors?¿Are parents allowed to access to private accounts of their minor sons or daughters? We will address all these issuesand we will try to make a critical analysis of the matter, highlighting the new challenges of Law retating to minors and social networks.

En ocasiones las TICS han supuesto un nuevo medio para la comisión de clásicos delitos, mientras que en otras ocasiones esta nueva realidad ha dado lugar a nuevas figuras delictivas que hasta su irrupción eran inexistentes o desconocidas para la sociedad y para el legislador. Cada vez más y con mayor frecuencia, los menores tienen acceso a dispositivos electrónicos y telemáticos a edades más tempranas, y con ello el acceso a redes sociales y la puerta abierta a todo tipo de peligros y riesgos. Pero, ¿conocemos realmente cuál es la normativa legal en esta materia y la edad mínima para que los menores puedan acceder a redes sociales? La cuestión nos plantea numerosos interrogantes: ¿a qué edad pueden los menores acceder a este tipo de redes sociales?¿Existe algún control de verificación y autentificación de este tipo de requisito?¿ Pueden los padres acceder a las cuentas privadas de sus hijos menores? ¿pueden los padres subir fotografías de sus hijos menores a Internet? ¿ cuáles son los nuevos ciberdelitos a los que los menores están más expuestos?¿cuál es la nueva regulación los ciberdelitos que más afectan a los menores como : sexting, child grooming, sextorsión, cyberstalking o ciberbullying?
