Summary: Spain is one of the countries that gets the most immigration flow, and for the lastdecades has passed from a country of emigrants to become the destination to immigrants [1]. Although Spain establish this last group’s rights in its Constitution, givesthe legal authority the possibility to set them up, accordingly, the immigration statute,develops and mostly, exceeds its faculties and restrains the use of their rights. It is thejudge´s say, the case law, the way to claim and restore them, turning them into a realityto Foreigners.
