Abstract According to the Spanish Constitution and included in the list of the fundamental rights of citizens, is the right of housing. The question to be discussed and the aim sought in the present research is whether or not, as a consequence of serving a sentence involving deprivation of liberty in a prison facility, a cell becomes a prisoner’s home or dwelling; it could be affirmed that it may constitute occasional housing, but not an inmate’s habitual residence or domicile. Likewise, it is necessary to give special attention to the question that if housing constitutes a preferential piece of social nature where home and (family) life can be settled, which generally is a housing unit, a house, an apartment or a set of rooms while a household space is where a group of people, often a family, live together and develop family objectives, the same cannot be said about a prison cell, since it does not meet any of these purposes. Therefore, it is neither housing, household, nor home, residence or domicile, but only the exclusive place where a sentence involving the deprivation of liberty is served. The method to arrive at this result works from a historical, descriptive and analytical perspective regarding both regulations and with respect to the Spanish prison legislation.

A questão por debater, e o objetivo da investigação atual, é se como consequência do cumprimento da pena privativa da liberdade em um centro do penitenciário, a cela transforma-se no o domicílio ou na morada do interno; deve-se afirmar que pode constituir a morada casual, mas não na morada ou domicílio habitual. Também, vai se prestar atenção especial à ideia se a morada consistir em uma parte social preferente na que se assentam o lar e a vida (em família), não assim na cela. Vai entender-se que a morada é esse espaço onde todos os alvos familiares são desenvolvidos, e o resultado da investigação é que a cela não contribui a tal alvo; consequentemente, não é morada nem domicílio, porque é, exclusivamente, o lugar do cumprimento da pena privativa da liberdade. O método para alcançar o resultado ocorre de um perspective histórica como normativa, além de descritiva e analítica, com respeito à legislação penitenciária espanhola.Resumen En atención a la Constitución de España, y dentro del catálogo de los derechos fundamentales de los ciudadanos, se recoge el derecho de la vivienda. La cuestión por debatir, y el objetivo de la presente investigación, es si como consecuencia del cumplimiento de la pena privativa de libertad en un centro penitenciario, la celda se convierte en el domicilio o en la vivienda del interno; se debe afirmar que puede constituir vivienda ocasional, pero no vivienda o domicilio habitual. Asimismo, se va a prestar especial atención a la idea de si la vivienda consiste en una pieza social preferente en la que se asientan el hogar y la vida (en familia), no así en la celda. Se va a entender que la vivienda es aquel espacio donde se desarrollan todos los fines familiares, y el resultado de la investigación es que la celda no contribuye a tal fin; por tanto, ni es vivienda ni es domicilio, al ser, exclusivamente, el lugar del cumplimiento de la pena privativa de libertad.
