Given this point, it is important to understand what the linguistic turn of events was, as well as its phases and influence on the human sciences in general, in order to understand how, through the philosophy of language, such philosophers as Kelsen, Ross and Hart have appropriated these concepts and “created” the assumptions of a new legal science. As a result, we present the influences that the theories of the Law of these authors suffered from the philosophy of the ideal and ordinary language of Wittgenstein and Austin.Keywords: Theory of Law, philosophy of ordinary language, linguistic turn.Este artigo utiliza metodologia eminentemente bibliográfica e busca lançar luz sobre como as teorias do direito se utilizam dos conceitos filosóficos advindos das teorias da filosofia da linguagem ordinária. Ante esse objetivo, importa entendermos o que foi a reviravolta linguística, suas fases e sua influência para as ciências humanas em geral, para, a partir daí, buscarmos perceber como, por meio da filosofia da linguagem, jusfilósofos como Kelsen, Ross e Hart se apropriaram desses conceitos e “criaram” os pressupostos de uma nova ciência jurídica.
